Terms of Service

Please read these Terms of Service ("Terms", "Agreement") carefully before using thecardcollector.com and related services (collectively, the "Service") operated by Leading Edge Data, LLC ("Leading Edge Data," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you represent that you are at least 13 years of age (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into this Agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

The Service provides tools for tracking, managing, and valuing sports and trading card collections. Features may include inventory management, cost and value tracking, market comp data, analytics, and related functionality. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Accounts and Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of any content you submit, upload, or store on the Service, including card images, collection data, notes, and other materials ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, and display that content solely for the purpose of operating and improving the Service.

You represent that you have all necessary rights to your User Content and that it does not violate any third-party rights, applicable laws, or these Terms.

5. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe upon the intellectual property, privacy, or other rights of others.
• Upload or transmit viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Scrape, crawl, or otherwise collect data from the Service without authorization.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Service for any illegal, fraudulent, or unauthorized purpose.

6. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other materials (excluding User Content), is owned by or licensed to Leading Edge Data, LLC and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you a right to use our name, trademarks, logos, or other proprietary materials without our prior written consent.

7. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, all licenses granted to you under these Terms will cease, and you must stop using the Service.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

Any market data, valuations, or comps provided through the Service are for informational purposes only and do not constitute professional financial, investment, or appraisal advice.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LEADING EDGE DATA, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Leading Edge Data, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of such courts.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the effective date above and, where appropriate, by additional notice (e.g., email or in-app notification). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Leading Edge Data, LLC regarding the Service and supersede any prior agreements or understandings.
